Does Pip lump sum for mobility affect my ESA

I have just received a back payment of over £8000 for PIP - do I have to declare this to ESA even if I want to use it some of it to pay if debts.

Hello edith,

You can use the money to pay off debts, the only thing I would say is make sure that you keep the evidence of where the money went, just in case you are challenged on it at some time in the future.

Hi Catherine,

Please forgive me for 'intruding' but unless the law has changed any backpay is ignored for 12 months and in some cases longer depending on the amount.

Congratulations on receiving this back-payment of PIP! When I won a PPIP appeal some years ago I received a large back-payment of PIP and also of ESA itself. I was at the time -and still am - on ESA income related. As this payment took my savings over £6000 this would normally have reduced my ESA payment however as this was caused by back-payments of benefits my tribunal representative advised me that for a year after the date of receiving the back-payments they would be disregarded for means testing under ESA. I suspect this will also be so for you but I recommend that you check this with a qualified rights adviser. If - as I suspect is the case - this also applies to you then you willl, if you want to, be able to spend all of this £8000+ exactly as you wish without having to 'justify' how you've spent it to the DWP.

I hope this helps but, as I've said, it would be wise to check this with a qualified welfare rights adviser.

Hi Mr B

You are correct, In some cases, this payment is not counted as savings for one year and will not affect your income related or means tested benefits during this time, such as UC.

However, where benefits have been underpaid because of:

* an official error
* an error on point of law

Any payments over £5,000 can be disregarded for the length of the claim or until the award ends.
