Can ESA medical be considered for PIP claim

I have been diagnosed with a life-long and life-limiting physical condition which significantly impacts my daily life. It has also increased my depression and anxiety.
I have not been able to work since 2019 and last year had a face to face WCA with a very understanding and knowledgable assessor. She had no hesitation about recommending that I was placed in the Support Group category and she also suggested I claim PIP.
I applied for PIP in March 2020 and after a very long wait, had a telephone assessment with a very patronising assessor who tried to put words in my mouth and had no understanding of my condition. I received zero points and one of the reasons given was as I had a bank account and had filled in the form myself which suggested I was mentally fine. The report also had incorrect information about the distance I could walk and totally ignored what I said about being in constant pain. I felt so humilated and demoralised that I didn't feel strong enough to go through the appeal process as I was really in a very low place. I now feel that I shouldn't have given up so easily and have started a new claim. I will be downloading your helpful guides and am starting to collect evidence. Can I ask that a copy of my face to face WCA report is made available to the PIP assessor as I feel it contains useful information that a telephone assessor will not consider.

Hello Jackie,

You absolutely can include it as evidence you submit with your PIP claim, but you cannot simply ask them to go and find it - the various departments do not often communicate that effectively with each other.

You don't say when you had your original decision on the application you made in 2020. You can theoretically apply for a MR up to 13 months from the date of the original decision, although the longer the time the better your reason for being late has to be. You will need to explain that there were special circumstances for the delay and it was not praciticable for you to apply within the month.
