Hello members,
I've been on higher rate for pip,when I was assessed 6 months ago they said I wasn't entitled to mobility and my living allowance went down to standard rate,at the time I was ill so didn't challenge it,didn't have it in me,my condition getting worse not been out of house since,my question is even though I'm getting pip can I still apply now has my mobility is getting worse and mental state worse due to been in house,I'm afraid that if I ring them I might lose my pip what I'm getting now and my claim for renewal isn't until next year,any help would be grateful, thanks

Hello Sully,

Although you can always apply for Mandatory Reconsideration within a month, if there is a good reason for a delay in doing so, you have up to 13 months in which you can apply. Clearly since your health permitted you from doing so before, you now contact the DWP requesting a MR, together with an explanation as to why you are late.

If you follow the link below and scroll down to ‘PIP appeals’ you will find guides to help you in this process. As part of your MR you should ask them to demonstrate how your condition has improved so that you are no longer entitled to the rate you were on before.

You can of course make a new application on the basis of change of circumstances, and your current award would stay in place until they had made a new decision. The advantage of the MR route is that any additional award would be back dated to the start of your current award.

There is always a very tiny chance when you ask for a MR that they might reconsider it down. It would be remiss of me not to say that, but I have never heard of this happening except in unusual and exceptional cases, and you would of course have the right to appeal that if you wished.
