hello phoned for copy of hcp report, first time i phoned i waited 35 mins and eventually hung up. phoned again, waited 55mins before someone answered, they said they had the report, and told me they would send it out and i should receive it by 2nd class post by the weekend, i expect i am lucky, as i only had my assessment Tuesday 29th June. i know i will still have to wait seven weeks at least for decision, but it might be interesting to see what the hcp has written,

Hi magpiejoe08

I usually use a highlighter to highlight any inaccuracies, once you have gone through the report go through each descriptor one at a time why you disagree with the assessor and try and match it with any supporting documents you may have sent in.

There is a small window for you to write to the Decision Maker but you will need to be quick.

Understand that the assessor is offering an opinion when they say that you can do the PIP activities, tackling these head-on is unlikely to be successful, you need to show that the basis of that opinion is founded on incorrect information, so try and refer to your evidence to undermine what they have said.

Also, try and stick to issues that lead to your scoring points, I often hear members referring to the assessors spelling, as an example, whilst it may show a lack of professionalism, raising it as an issue isn't going to help you get an award.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

Lastly, make sure that you understand the criteria that you are being assessed against you can put the best case forward that is possible but you won't score points if you do not meet the PIP Descriptors.

Make sure that your letter makes it clear that you are not requesting a Mandatory Reconsideration but you reserve the right to do so once a Decision has been made.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide, half way down the page for details of the process, the PIP area also has template letters that you can use to make the request with.

yes i will do everything you advise, i only have two points to disagree on, that is walking, and the help i need dressing and bathing. i know this is stating the obvious, but this will be my third pip assessment, although my first by phone, the other two assessors agree i need support and my condition will probably deteriorate in the long term, this has been the case. Does the dwp put you through this nonsense just because they can? or do they only take notice of the hcp's when it suits them.

Hi Magpiejoe,

When you write in with the points on which you disagree, you might also want to consider confirming the points on which you do agree.

Given what you say about your condition only likely to deteriorate in the long term, you might also want to look at how long the assessor has recommended your award lasts for, particularly if you have any evidence that your condition is not likely to improve.

Hi magpiejoe08, a non-mod's take on your question. Not just because they can, but because it fits their business model to make many claimants drop out or accept a lower award than they know they deserve, due to the very illness or disability leaving them short of the ability to fight. They can pretend claimants are getting what they deserve as they keep assessing them, but in reality it reduces the money the government have to pay out. [So they can buy eco-wrecking HS2 rail project, pay over the odds for duff PPE etc IMHO].

Good luck with getting your report, I had to request mine three times before it arrive, so please keep an eye on when you requested it and when it is due by incase the same happens to you.
