Oh god not again :( was created by Judy
On my telephone assessment I got the enhanced mobility, like before, but I've been downgraded to standard daily living. I only knew because my PIP payment today was not my usual amount, so rang PIP up. I informed the case manager that I wanted an MR and a statement of reasons. He said to wait until I get my letter informing me of my new PIP amount before I ask for an MR. I was referred to a case manager because the original person couldn't answer why I had less money coming in.
I realised straight away that I'd been downgraded but wanted confirmation of it. So back to tribunal again then :( I'm wondering how I got downgraded considering I haven't gotten any better.

Hi Judy,
I'm sorry to hear that your recent assessment failed to acknowledge your long term disabilities. It is always very disappointing and frustrating when this happens. More to the point, it happens all too frequently and for no obvious reason. Channel your inner energy and put thus into doing your MR, which I hope will get your benefit reinstated.
I suggest you ask for a copy of the Assessment report, P4A. This should be ready now, given the payments have been reduced Hopefully this will arrive in good time to do an MR, if you request this now.
By law if DWP do reduce your benefit they have to make a full and cogent explanation.Mere recent of a new assessment report is not enough. Because DWP have changed your benefit, this is called a supersession. Whilst you wait for the P4A report have another look at the members guides and make sure you are absolutely clear where you should award points. You may have time to get medical reports if you haven't done so already. If you have a copy of your previous claim form/s look them out. Be brutally honest and think how things were then, and what points were awarded and was this correct. Have you got worse, if so how, what has changed, how can you prove this? Things like surgery, increased visits to GP or other medics, increased or more effective medication can also serve as proof.
Use bullet points, and when the actual decision/assessment report arrives go through these and compare with the previous form. By all means criticise the report, but the beat way to do this is to make one or two generic points saying that it is poor quality, answers weren't correctly recorded, assessor not listening, was rude etc as appropriate. Dont bother to Crucis everything, pick one or two of the worst examples. Then carefully go through each descriptor . If things have changed explain the previous points and what is now worse, and the correct points. If the same, again mention you still have X problem and should receive Y points still, but only Z points have been awarded.
Hopefully your MR will be successful. Good luck.
