PIP phone assessment cancelled on the day

Hi Oceanwave

Glad to hear you got through the assessment. Yes, it is common for the PA4 to take more than a week to arrive. Usually they quote it will arrive within 10 days, but sometimes it is longer.

Today I received the assessor's report, PA4. It is really upsetting. She makes out that I have no problems other than using the toilet, everything else is fine. In each area (apart from using the toilet) she mentions that I have a driving license in her 'justification for descriptor'. She says I have no input other than GP, when I am under the care of a psychiatrist (and now an OT and a physio).

I am feeling both devastated and angry. I know I need to write asap to state where I think I should get points and point out things she has got wrong. But my head is a bit all over the place today. It is also the anniversary of a tragic event for me, so it was not the best of days to begin with.

Sorry for the rant. But my previous PIP award was Enhanced Care and Standard mobility due to my mental health problems and the effects of my brain injury on cognition and balance.
Please could you advise me who I should write to and whether I should phone the DWP to say that I am going to write? My assessment was 2 weeks ago.

There is a small window for you to write to the Decision Maker but you will need to be quick.

I usually use a highlighter to highlight any inaccuracies, go through each descriptor one at a time why you disagree with the assessor and try and match it with any supporting documents you may have sent in.

Understand that the assessor is offering an opinion when they say that you can do the PIP activities, tackling these head-on is unlikely to be successful, you need to show that the basis of that opinion is founded on incorrect information, so try and refer to your evidence to undermine what they have said.

Also, try and stick to issues that lead to your scoring points, I often hear members referring to the assessors spelling, as an example, whilst it may show a lack of professionalism, raising it as an issue isn't going to help you get an award.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

Lastly, make sure that you understand the criteria that you are being assessed against you can put the best case forward that is possible but you won't score points if you do not meet the PIP Descriptors.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide, half way down the page for details of the process, the PIP area also has template letters that you can use to make the request with.

Make sure that your letter makes it clear that you are not requesting a Mandatory Reconsideration but you reserve the right to do so once a Decision has been made.

Hi. I have started a letter to the Decision Maker about the inaccuracies in the Descriptors on my report. But my fatigue has been really bad and so I haven't been able to finish it yet.
I phoned the DWP today to see if a decision on my PIP had already been made. They said no. I said I would write to the Decision Maker - and was told to wait until I receive the decision letter. I don't think I will wait - but if you have any thoughts on this, I would love to hear them!
The DWP person I spoke to asked if I would like him to put a note on the file saying what the main inaccuracies were. I told him 3 of them that run all the way through the report / descriptors.
Do you think it is best for me to still get a letter in to the DM before the decision is made? My brain is so tired with all of this, I'm sorry if I am not being very clear / concise.

Only you can decide whether or not you have the energy to finish your letter to the decision-maker. If you can, then really you have nothing to lose by sending it off. Whether it will get to the decision-maker on time, no one can tell you. Nor cancan we say whether it will make any difference. But plenty of people do write and some have found that the decision awarded is different from the assessors report.

I hope that your fatigue stabilises enough for you to do whatever you think is best right now.
