Hi all,

I am trying to support my friend who is having to claim UC after a change of circumstance.

My friend is on IR ESA in Support Group gets SDP, PIP both Enhanced

What we are confused about is:

1. How do you do a UC claim and get Limited Capability to Work/SDP etc recognised?
2. Is the "attach a fit note to UC claim" a routine thing, is there a way to submit the claim without it?
3. Is there no continuity with ESA/SDP until UC assessment and how do you get this?
4. Is assessment immediate or will my friend get JSA level until assessment?

Sorry if these have been discussed before. The whole UC system is so overwhelming and confusing.

Hi Josh

A UC claim is made on line, if you are good with computers then it is relatively straight forward, your friend will need a 'fit note' to give to their work coach. I would also send them a copy of your friends latest ESA breakdown letter showing what premiums they are getting via the Journal.

It does depend on your friends change of circumstances as to whether or not they get transitional protection, they will need to seek advice from their local Welfare Rights Organisation.

To claim LCW/LCWRA you do need to submit a fit note. Your Assessment Period does not start until you do?

If you are receiving the SDP and have a change in circumstances that prompts a new claim to UC, you will now need to claim UC instead of your existing benefits.

When you make your claim, a top-up SDP transitional element may be included in the calculation of your UC award.

There is no continuity when you apply for UC your ESA claim will cease, you need to make sure you have all the relevant information to hand before you start the process.

Assessment is not immediate, the assessment phase is 13 weeks, your friend should get UC + SDP transitional element in their first assessment period if eligible. There is an SDP enquiry line: (0800 181 4049), to deal with any equeries.
