Hi

I have MS, which includes drop foot, I also have chondromalacia patella (basically arthritis) of both knees and Osteoporosis.

In 2014 I was awarded maximum points for both components of PIP.
About 18 months later I had a F2F review (ATOS) and they decided to award me zero points on both components. I appealed and got minimum rate for Daily living and zero for mobility.
My mobility has got a lot worse since then.
Last year I became a pensioner!
If I applied for the mobility component would it still be classed as a new claim as I got it before?
I have had a couple of letters extending my current claim.
I cannot get Attendance Allowance as I get PIP.

Any advice would be greatly appreciated.

Hi Carole

If you are under 65 - you can put in for a claim for the mobility part of PIP, but if you are over 65 you will not be able to do so.

Hi Carole

You state in your post that last year you became a pensioner.

The relevant age is State Pension Age.

You cannot be awarded the Mobility as a new or an increased award after you reach the relevant age with the exception of the initial transfer from DLA to PIP where the age restriction is suspended.

If you have a Mobility award before the relevant age then you can continue to receive it after as long as you continue to meet the criteria.

MRs and Appeals remake the Decision being challenged and apply from the same date so if the MR or appeal takes you past the relevant date you can still receive the Mobility Component if awarded as long as the original date was before.
