My friend has just had his telephone assessment. Long story short, 9 years ago accident at work, he sued, he won out of court settlement. Hurt back but due to not being able to work has got severe depression. Had doctors and specialist assessments, got reams of paperwork. But that was from back then. So up to now he's just relied on anti depressants and pain meds, because he doesn't want to get addicted and live his life in a fog. His last mental assessment and help was about 9 years ago. So this is the problem he's having now. DWP are saying he can't have any PIP because there is no paper trail, so no proof he's disabled. They also tried to contact his doctor but said the doctors don't have to talk to them. What the heck can he do now please. He's asked for the assessors form to be sent to him.

Nine years is a long gap to have no further evidence. However, if your friend is on pain meds and antidepressants, I should hope that he has seen a GP during that time (eg a review of his medication).

Your friend needs to contact his GP and find out whether the DWP has tried to contact them. (They're not always truthful about this). Whether they have or not, he needs to explain to the GP that he is being refused benefits because he has no record and ask if they will write a supporting letter. If they refuse, you can ask for a copy of your medical records and send off the relevant information himself.

Your friend also needs to look at what was written nine years ago. What was the prognosis of his back, what did they say about future difficulties. He needs to highlight in a mandatory reconsideration what that information contains. If they contacted his GP it means they didn't think they had enough information, so he needs to go back through what he does have, but make sure that he links it to the specific PIP criteria. When he gets hold of the report, he will also see in detail what the assessor said. If they said nine years ago that his condition was not going to improve then he can add to his evidence there is no reason for him to keep consulting specialists.

If he is going to put in for a Mandatory Reconsideration, he needs to do so within one month of the date on the Decision Letter.

Yes he's been seeing the gp, re, suicidal thoughts and the gp upped his anti depressants and that was all really. Covid stopped us all from seeing gps didn't it.

I forgot to say that the assessor stopped the assessment for 15minutes to speak to their supervisor and this is what they advised, no PIP.

Hello Judy,

Your friend could also request a copy of medical records. If the GP is not willing to give them as a result of an informal request he has a right to make a 'Subject Access Request', which means under the rules of GDPR he has to be provided with them. He needs to be careful when he makes the request to specify exactly what it is that he wishes to see.

I made a mistake in my first post.... It was not DWP who said my friend couldn't have PIP, it was Capita! My friend rang DWP today to ask for the assessors report and told them that Capita had stopped his interview after half an hour because THEY had decided he couldn't have PIP. They hadn't even asked him any questions about the descriptors, they didn't get that far into the form. Well to say the DWP were furious is an understatement. DWP said it is NOT up to Capita to decide if he gets PIP or not. They said Capita do not have the final say they do! And that they had no right to not finish the report. Curiouser and curioser. So he is waiting for a call back from DWP who say it could take three weeks to call back.
