Hi I’ve been awarded PIP for 10years (I’m 61).
I have been awarded High care and low mobility 8 points walking distance. However I have a letter from my consultant which I did not send to the dwp. It came a few days before my decision. Initially I was going to accept the decision ( I had a call from a decision maker advising me of my award.) I’m now thinking of asking for a mandatory reconsideration, I’m afraid though that
my award may be reduced,
the duration may be reduced
Or I may have to go for assesement ,
I didn’t this time the decision was a paper one.I’m appealing because due to my illness I have severe anxiety due to drop attacks my consultant has written. She has quite significant social anxieties about going out in relation to the drop attacks and the PPPD. He has referred me to neuropsychology to help with some anxiety management about the distress she experiences about going out. I’m your opinion and with the experience you have from hearing from other members do you think I should do a mandatory reconsideration ?

Hi Lorraine,

If you were one of my clients who I knew well I would struggle to advise you this one, and it is impossible without that sort of relationship.

Factors to consider are:
There is a risk when they review your award it could be downgraded, rather than improved. I have never personally experienced this, but I have heard of it happening in very exceptional cases. If they do downgrade it, then you have the right to appeal that decision.
How strong is the additional evidence? I am confused about whether the consultant has written that you have severe anxiety or quite significant anxiety. They are very different statements.
There is a risk that since you are being referred for treatment in relationship to going out that they might decide to give you an increased award for now, but for a shorter term, since if the treatment is successful you would no longer meet the criteria for the higher award.
I do think there is a reasonable chance they might ask telephone assessment.

However, for all those possible negatives, remember that any award you get prior to State Pension age, and carries over that magic date, then, assuming your condition does not improve, you will keep forever.

Thank you Catherine for your invaluable help. I have decided not to proceed with mandatory reconsideration. I agree with the points you made . I’m not mentally strong enough to challenge them and will worry about my award being reduced and or the period being reduced. Thank you for clarifying what I already had concerns about. Your help and guides have made the daunting task a bit easier
