The last time I claimed PIP I had to go through a mandatory reconsideration and then a court tribunal just to be awarded the standard mobility component I feel I have the rights to, this really had a negative impact on me being the ordeal that it was.
Naturally suffering from mental health conditions and feeling like I have to constantly 'prove myself/condition' the whole experience left me greatly hesitant to put in a fresh claim after the two years expired and have not reclaimed in a further two years.
However, during lockdown and my wife's furlow I phoned the DWP around February or March to make a new claim for PIP under mental health grounds.
I did not fill in the claim form due to my hesitancy thinking back to my ordeal and expected my claim to be closed.
I have today though received a letter for a telephone assessment in 11 days time.
Can they make a decision solely on this telephone assessment? Would I fail assessment due to not submitting the claim form? Somewhat confused as to what to do so any advice would be appreciated.

Hello Nick and welcome to the forum.
What I GUESS has happened is that when you rang them earlier in the year you revealed that you had significant mental health issues. They have then assumed that these have prevented you from tackling the form, so have arranged for you to have an assessment anyway. (Note to anyone else reading this who has mental health issues, please don’t rely on them doing this every time.)
If you wish to, you can obviously withdraw your claim, and not go through the assessment, but then you would definitely not get any PIP. You can still fill in the form and submit it, but the assessor will probably not see it before your assessment, but it will be read as additional evidence.
You will not automatically fair the assessment because you have not completed the form.

Thanks so much for the very prompt reply Catherine.
I think I will continue then and prepare for the telephone assessment with my wife present to help explain some of the difficulties I face.
To have already come through the process thus far of the claim even without any form submission to be given an assessment I am now in the mindset to at least continue rather than withdraw.

Good for you Nick and Mrs. Do call ASAP and ask for it to be recorded. This maxes your chances of a fair award in the end. I hope for instance the assessor you get will happily listen to everything your wife has to contribute - but if you get a stroppy one who won't, you need that recording to prove that the evidence she would have given was left out as a result.
Hope it goes well, and do call/ask your wife to, 48 hours after the assessment, to ask for your copy of the PA4 assessment report. If unhappy you can write in ASAP to The Decision Maker, at DWP. Coldly debunk all deceits and omissions etc referring to what was actually said [on the recording, extra important as you didn't do a form]. If necessary you can add eg quotes from the NHS website to back up your version against theirs.
