ive not heard of it before but dwp have used it against me in tribunal submission, it says if i understand it correctly that the assessors do not lie or make stuff up in any way shape or form, as what would they gain.
its a bigger b/s then man set foot on the moon.
makes me want to self harm and spray the blood all over them and gray report author.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi ccc
That is why we say to members get a copy of the assessors report then go through with it line by line with a highlighter, go through each descriptor one at a time, as to why you disagree with the assessor and try and match it with any supporting documents you may have sent in.

Dear ccc, if this is what the DWP have claimed in their submission to Tribunal, remember the judges have heard it all before. They know some reports are 'not of acceptable quality' -polite-speak for bs*. And at least 70% of people [don't know the latest figure] are winning at Tribunal because for all the faults of our judicial system, they ARE independent of the DWP. My hunch is that out of members of this site, it is probably higher than that due to the excellent guidance.
Best wishes,
Denby

Hi ccc,
I have just had a read of some of the latest Gray Report. Here's the link if anyone is interested and has several hours to spend!
assets.publishing.service.gov.uk/governm...dependent-review.pdf
On page 45 the report states that 65% of appeal cases are won at tribunal. At page 46 para 36, the report says that discussions with Tribunal Judges reveals that cogent oral evidence from the claimant is the most common reason for overturning a decision. This means that either the evidence isn't sufficiently well collected or convincingly analysed during the assessment or isn't written up correctly. The report adds that it may be due to Assessors and Judges coming to different conclusions on the same evidence. But hem adds basically no one knows so more research is needed!
The overview at the beginning of the report says that restoring claimant trust requires that the assessment process is of demonstrably high quality and produces fair and consistent outcomes.
Unfortunately this comment isn't easily reconciled with the comments made earlier in the report, as mentioned by ccc, that Assessors don't deliberately lie. Well perhaps they don't, but then perhaps they can't collect evidence or analyse it or write it up properly as suggested in the report!
Food for thought!

Unfortunately physiotherapists, paramedics, mental health nurses and the like are never going to have the same level of analytical skills as a judge, which means the whole assessment system is fundamentally flawed.
