I am feeling down, frustrated and exasperated at the entire process of this continually flawed system for the thousands effected including myself.
I have now gone to the next stage moving towards a hearing. On the very last day set by HMCTS we received updates via email to say the DWP had now responded and a hearing needs to be arranged. It is explained this could actually take several months adding onto the 5 months we've struggled by up to this point.
In today's post we've recieved copies exactly as the email from the tribunals service. No copy at all of the DWP response!

Will we receive a copy giving us enough time to prepare or is this another despicable tactic of avoidance & delay?

Is it possible the appeal can be looked at before it actually went to a full hearing?

I am trying to dig deep and find the resolve to fight this deplorable system and I fully empathize with anyone in such a position as it is not easy. This broken mismanaged system has to be fixed and replaced with some common sense. A one size fits all tick box approach is flawed and leads to poor assessments. The lack of knowledge, prejudice, disparity and discrimination from this process are leading to the wrong decision. It badly affects people's wellbeing and can devastate families lives.

Hi Steve

I'm sorry that you're having to go to appeal. It is a long drawn out process and like you, thousands find their mental health deteriorating because of everything they have to go through.

You will in time receive a bundle from the DWP which is the same as the issue to the panel with all the information pertaining to your case. You should receive it in plenty of time to draw up any response that you want to.

Sometimes the DWP do actually change their mind before the appeal and offer claimants a new offer, but this doesn't always happen. Sometimes the DWP don't offer any evidence in which case the Tribunal panel normally finds against them.

I hope that you do have the energy to keep going. The majority of appeals are won by claimants so if you can cope with the awful stress, it's worth having a shot.

Kind regards. I/we will continue with our best efforts to overturn the flawed decision. It needs to be challenged for the sake of all that endure this torture.
I am an honest man with a long medical history I had inflicted upon me without choice. It has brought challenges for myself and family with which this system continually adds to.
No one should have to fight so hard to prove their difficulties when evidence is there to support them. The disparity, lack of knowledge and empathy between contracted assessors is not fit for purpose. So many cases being overturned continually highlights something is fundamentally wrong.
At personal cost for many who find the strength to fight and such tragic loss for those unable, it has continued for far too long. For everyone greatly affected we will try and push to challenge and change something that is flawed for what it aims to support.

Hi Steve,
Unfortunately the appeals process can take a while. I don't think this is the fault of DWP. I think the whole system is underfunded. Even when DWP have produced all the papers it takes a long while to get a space for a hearing. (This is solely due to HMCTS.) There simply aren't enough courtrooms/tribunal members to go round. The delays are seriously frustrating. However, please don't give up. Most tribunal hearings overturn zero points and provide an award. The success rate at tribunal is very good. Remember that if you win your appeal, you will get backdated money to the date of claim or review date, so you won't lose any money even though there may be a delay.
Please keep going. Don't give up!
