HI! I won my PIP Tribunal got awarded Enhanced on both for 5yrs. Got sent a review form (although had read stuff online that Tribunal awards got totally reassessed!) lost both awards just had results of MR and been refused - I referred to the UT ruling as it was a review but they are saying that as I had a Tribunal award it was a new claim - but they sent me a review form which I filled in so am a bit confused as to where i stand on referring to the UT ruling as they reviewed me and didn’t totally reassess. Am still going to appeal and go to Tribunal as it’s again a total load of rubbish but need some advice re the fact that they reviewed me - which I’m assuming was mistake on their part but as I was reviewed surely the UT ruling applies?!? Any advice would be appreciated. Thanks
Hi Sarah, DWP are a bit fickle about reviews where there has been a tribunal decision. They say they won't but then clearly do! I drafted a letter on this forum for someone and who had been told to reclaim, and hence would have lost continuity of payments. I phrased this as a complaint and it clearly worked as she was reviewed instead of having to do a new claim. I wouldn't worry about the legal intricacies of review or no review. If DWP give you a review, you'll be paid until the new decision and beyond if successful. Good luck. LL26
