Moving from Disabled Tax Credit to Universal Credit

I currently claim Working Tax Credit having moved from ESA some years ago.

I was assessed as unsuitable for work and work related activity while on ESA and because I had been claiming ESA for more than 26 weeks, I was classed as disabled for tax credits purposes and therefore have the disabled tax credit component in my claim.

I currently work in a self-employed capacity 24 hours per week in a role which is extremely specific to needs.

I have received a letter in February telling me that I must move to UC within three months or my tax credit claim will stop, I understand that I will receive transitional protection when I move to UC as I have not had a change in circumstances and I will be moved under the managed migration process.

I am worried about whether this transitional protection will apply to the rules about capital allowances and the minimum income floor. The profit from self -employment is approximately £6000 annually and I have capital of approx £9000.

My current tax credit claim pays me £104 per week and I am unsure what I will be paid under UC.

I do not have children, live alone and do not claim PIP or DLA, I own my home. I am worried about the move to UC and whether I will have to undertake a new WCA or whether my UC would commence based on my entitlement to Disabled Tax Credits.

Any information would be gratefully received and I appreciate you taking the time to help me.

Hi Thom

You raise some very interesting questions, I would advise you to seek advice from your local Welfare Rights Organisation who will be able to take all your circumstances into consideration; advicelocal.uk

You can do a benefits check, gov.uk/benefits-calculators
you will find a list, I believe Policy in Practice benefit calculator is able help self-employed claimants.
