Hi everyone,

My son currently receives the middle rate for care and the lower rate for mobility on DLA.

He has a change in mobility needs and needs more support. I finally got through to the telephone line today and explained only to be told that they will send a form out for me to update his additional mobility needs but that it would affect the whole claim as they will look at it all again and this means the rate could go up or down.

Before I could ask anything else the line went fuzzy then cut off. My question is, does this mean it will be like a brand new claim and will it then go to UC instead of staying as it is as a legacy benefit?

First to clear a misunderstanding. DLA and UC are completely separate benefits. UC provides additional support to working age claimants on low income or those unable to work due to illness or disability. DLA provides support to children and older claimants to help them meet the additional costs they might have due to their disabilities.

To try and answer your question, the DWP can review the whole claim again from scratch and this can result in a different award, it used to be possible to state that there had only been changes to one component, this may still be the case but I cannot guarantee it.

Be aware, the criteria for Higher Rate Mobility is fundamentally different from the Medium rate, there is no "transition" from one to the other.

HRM looks at your child's ability to walk in comparison to children of the same age, so you will need to show that he is unable to walk or is virtually unable to walk, there are some other criteria such as blindness, see our Child DLA claim guides.
