WCA timeframe was created by Stephen M
Having just been unsuccessful with my WCA and found to be fit for work, i have a few questions. I've just been waiting for the decision before i add another health condition to my UC account.
1: In general, after a WCA decision and made fit for work, and if another health condition is added, is there a specific time period before a second WCA can take place?
2: More importantly as I'm appealing and i figure the whole process up to any Tribunal could be between 6 months and 1 year, would this automatically stop a second WCA being started? I'm thinking they couldn't run concurrently?
3: If i was still made fit for work after any Tribunal and with another health condition taken into consideration, would a second WCA be able to proceed immediately after the tribunal or not?
Hopefully you can give me a better understanding of my options.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi Stephen M
The first thing you need to do before doing anything is get a copy of the assessors report called a UC85 once a decision has been made, you can then see what you are fighting against, from your post I am not sure if you have received a decision.
You say that you are appealing the decision but you have not stated whether or not you have asked for a mandatory reconsideration.
I would advise you to seek help from your local Welfare Rights Organisation; advicelocal.uk they will be able to take all your circumstances into consideration when giving you advice but you do need a copy of the assessors report.

Thanks
I requested the assessors report immediately by calling UC but they were less than helpful. They eventually said it has been done but were unable to say whether it would be posted or just uploaded onto my UC journal.
Yes i had the decision over 1 week ago and made fit for work.
I've not yet requested a MR as I'm waiting for the report firstly and i stated this in my journal.
Should i make a MR now and before i receive the report? If so, what's the quickest way to do this?

Hi Stephen M
Only you can make the decision, but remember time limits.
You can make a MR request either by phone, in writing (letter) or using CRMR1 form.
I personally would prepare for the MR whilst waiting for the assessors report, if you don't get the report in time put in for the MR, if you send the MR by post send it by recorded delivery. Quickest way is over the phone but get prepared before you make the phone call.

I called UC to request a MR today and while I'm still waiting for my wca report.
I was under the impression that i have to decide what work group i think i should be placed in and why?
The person i spoke to just said he will request the MR now and it will go to my case manager and they'll make a decision and provide an option to upload any additional information like medical reports.
I'm confused with the process doing this. When do i get to tell them what group i think i should be put in and the reasons why? Also with you saying to be prepared if i make a MR by phone, what exactly do you mean as he basically said nothing about any input i can give.
I didn't let him request the MR until i know more about it.

I'm afraid you do not get to choose which Group you go in, this is entirely down to the DWP and you should most likely expect to be placed in the All Work Group.
To pick up a question from your original post that I think we missed, you can request a new WCA at any time but you must be able to provide a new Fit Note which defines a deterioration in your existing conditions since you were last assessed or a new condition, either of which the DWP accepts could lead to an award of UC. If they reject the Fit Note then there is right of appeal in regard to the new Fit Note.
