I apologise in avoidance for my grammar and spelling mistakes i do not do well in the written form.
Had my PIP face to face appointment i was awarded high rate mobility slandered rate care I had a mind representative with me I recorded the appointment. i won my last award by tribunal i was awarded high rate care lower rate mobility.
there are other points in the award letter but i will concentrate on one I only needed 3 points to get enhanced rate care
I asked for a mandatory reconsideration whilst i was getting the papers ready they sent a rep[ly before the month was up and it upheld its decision I was stunned the mind representative said it would be ok if it was late as he was busy and i could not get an appointment but even so the letter was sent before time was up i phoned and explained so why is there a box at the back of the form if you sent the form in late and why (overall jist) phone went quiet still refused to accept what i was saying to cut a very long letter short i was told they would look at it again they upheld their decision.
The mind representative has said that i have up 90 days to decide weather i go to tribunal bearing in mind he said don't worry about the form going in late yet it was a big problem how long do i have to tell PIP that i want to go to tribunal and how much time do i have to get the bundle ready.?
Here's my problem I sent in the dosset box inlet with the medication in it and i gave an up to date copy at my appointment and he took it and took a photo copy of it in everything i have read states i should have been awarded points for this but i have not received any points (do they think i am lieing) Is it worth me going to tribunal ( i don't think i can go through that again) there are other points on the table, mixing with others and preparing food,

I'm sorry you find yourself in this position. I don't understand where your MIND rep is getting their information from.
When someone puts in for a Mandatory Reconsideration they have one month from the date on the decision letter. If someone misses that date they have 11 months to put in for a late Mandatory Reconsideration - explaining why they are late. The DWP does not have to accept the reason and could refuse to consider it.
After you were turned down for the MR - you should have had a phone call explaining why.
When someone puts in an Appeal - they have one month from the date on the decision letter (Mandatory Reconsideration). Again, people have 11 months to put in a late appeal.
This information is laid out in our 36 page Guide to PIP Appeals.
You can put in for an appeal and if you want to add evidence at a later date, you can do so.
I can't tell you whether or not you should go to a Tribunal. The issue of the dosette box will only earn you 1 extra point - so you will still need to be awarded points elsewhere.
If you think you can't go forward for another Tribunal you could request a paper-based decision. The chances of your success are not as great, but some people feel that's all they can cope with.
