Hiya all. I'm after abit of advice about a few things. My son lost his pip 6 years ago and we took it to a tribunal and he was awarded it again. He is on the autistic spectrum. Yet again dwp have stopped his pip again following a telephone assessment. And they have refused the mandatory reconsideration. So, again, we are taking it to the tribunal . He was awarded 4 points for face to face and 4 points for communication etc, as opposed to dwp 0 points! A few weeks ago a health assessor working on behalf of dwp rang me out of the blue. I didn't have my notes with me as I wasn't expecting the call and the call lasted for 10 minutes only and she only asked solely about his work. At the beginning of the call, she told me that she had her dog sat on her knee because he barks and she apologised in advance if I hear him barking. Should I include that on the tribunal form do you think? I also rang dwp pip yesterday asking for a case manager to ring me back and was refused outright. He just said NO in a very abrupt way and I was shocked and said pardon? He said short answer is no, they won't ring you back. Is this correct does anyone know? I became abit flustered and tongue tied as he can't me off gaurd with his abruptness and i didn't like the way I was feeling one little bit! But, he did go on to ask me what I wanted to know and he explained to me. When I received the decision makers letter, he had wrote on it solely about my son not meeting the criteria for pip. He wrote , the evidence indicates you have the ability to carry out daily living activities used to assess eligibility for pip to an acceptable standard. This has confused me as this has never been wrote in past reviews, letters etc. When I rang dwp yesterday, the man said it applies to his work, he works and the man said he must need help ALL the time and because he works , it shows he doesn't need help ALL of the time. Is this correct, does anyone know? It also says on the decision makers letter that my son must need help All the time.

Don't mention the dog, it will not help his appeal.

There is no legal requirement for a Decision Maker to phone the client when a Decision is made, we do hear on the forum of it happening but it is definitely the exception rather than the rule.

Whilst it is perfectly possible for a claimant to work and receive PIP, it does provide an extra hurdle that a claimant will need to overcome, how can they work and still have the limitations they claim in regard to the PIP activities?

If this was not explained in detail on the form then assumptions will have been made.

No, your son does not have to be limited all of the time, the requirement is the majority of days after the "reliability" criteria have been applied.
