My partner is currently on IR ESA. He is about the recieve 30K inheritance which would obviously take him over the 16k limit. He needs to move out of his current living situation and wanted to put the inheritance towards rent which should cover him for about 3-4 years rent. I'm just wondering If he proves to the DWP he will use the money for rent then would he be allowed to to stay on his IR ESA? what the rules are regarding lump sums?
The Regulations are black and white on this issue, more than £16,000 in assets and savings and you lose entitlement to ESA(IR).
However, if your partner also qualified for Contribution Based ESA when they claimed then this will remain in payment as it is only affected by pension income.
