Managed migration from wtc to uc and ESA CB was created by JLC
Hi
Seeking clarity, we are a mixed-aged couple facing the managed migration to Universal Credit (UC), and I need advice and clarification on several points as the deadline is next week.
• Partner has deferred his state pension, is self-employed, and currently claims Attendance Allowance (both higher components). Has early-onset dementia.
• I claim Disability Living Allowance (both higher components) and CB ESA (old style) in the support group.
• Key Questions:
• When we apply for UC, will my old-style contribution-based ESA be affected, or will it remain unchanged I can't find anywherea simple answer?
• Are we both required to attend the Jobcentre for an interview, given our health conditions?
• Reporting self-employment income: My partner's income is normally calculated annually by an accountant, not monthly. We are worried about submitting incorrect figures as we both struggle with numbers due to my cognitive impairment and his dementia. Is there specific support available to help with this?
We are extremely anxious about making mistakes, particularly regarding self-employment reporting, as we fear fines or worse. Any advice, resources, or guidance would be greatly appreciated.
Kind regards
J

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi jennylchan,
Please refer to my answer to your other post of today.
On Managed Migration your old Conts based ESA will change to New Style ESA which is basically the same thing but you need to agree a Claimant Commitment. But this can be done over the phone.
A lot of Forum members are asked to attend the Jobcentre but after a complaint are usually given telephone appointments.

Hi David
Thank you for your responses.
I'm still confused about the CB ESA, when I spoke with DWP they said that there are no changes to CB ESA only people claiming IR ESA will migrate to UC?
Am I required to do anything, can I not continue with my CB ESA and not change to new style whilst migrating or is this compulsory to change to new style ESA? You advice is much appreciated.
Kind regards

Hi JLC,
You will find the information in the BenefitsandWork guide to Managed Migration quoted here ---
If you get contributory and income-related ESA
Contributory ESA (also known as contribution-based ESA) is not a legacy benefit and so is not
affected by managed migration and you will not get a migration notice.
However, if you were receiving a ‘top up’ of irESA, you will move to UC via managed migration
and UC will replace the irESA payment only. Your contributory ESA will change from being
called contribution-based ESA to ‘New-Style ESA’, which is really just a new name for the same
thing.
Your ’New-Style ESA’ is deducted from your UC award pound for pound.
If you are in the support group on contributory ESA, you should automatically be classed as
having Limited Capability for Work and Work-Related Activity (LCWRA) for UC. This means that
the LCWRA element should be included in your UC calculation, which helps make up for some
of the deduction for your ESA from your UC award.
