Hi all, I received a migration letter a few days ago.
I read a government WCA guideline, publicly available, stating that if during migration from ESA to UC your WCA review is past the review date you would automatically be refered for WCA 3 months from UC claim date. I have not had a review for WCA since 2016 it was due 2019. I'm in the support group. Couple of questions....

Q1. Would this be a EA50 form and will it be sent to me immediately or does it mean when they get round to it as resources allow. In otherwords many months?

Q2 I notice that for non dependents, with UC there is only a flat rate monthly deduction. This is strikingly different from ESA where it is a weekly rate depending on their earnings and hence much more a month. What if the non dependent gives you more than this monthly flat rate on UC. Wouldn't that be classed as income? or dont they concern themselves anymore with their weekly earnings etc now.

Hi roadrunner

Thank you for the link to clarify the government statement. Firstly the statement was made under the previous government and the new government and new DWP leaders may have different plans. There are going to be major announcements about Benefits cuts on the 26 March.
Also there is a huge disparity between what is a planned protocol and what actually happens. When a person has had a WCA the DWP write the review date which is called the prognosis on the ESA Opstrat system. This doesn't give any indication when the review will take place. There are forum members with a prognosis date in 2019 who are still waiting for a review. With Managed Migration they are having to write a date on the new IT called The Build but that has no bearing on when the UC50 will actually be posted and the WCA will occur.
I think we may hear more on the 26 March.

Yes, we all are waiting to see what the government is going to do. My concern with a wca was if I got put into the lcw group from being in the lcwra I may not get the lcw element in uc as they might see it as a new claim despite migration from esa to uc. Not sure, but everything might change in the announcement that is coming.
