Maybe a hard question to answer regarding self employment and wca

Hello, my
Partner is over 60 and is self employed . He has long term physical health problems . He had to do this route as he is basically unemployable due to
Time he has off which can happen anytime . We had to change to
Uc last year from working tax . Changing has been beneficial as we struggled for years . He added his health problem when we signed up
To UC and was giving the uc50 form. He had the assessment and found out that they recognise he has hearth problems but fit for work. He was not looking not to work just for them to understand that he does need time off when he can’t function and obviously be sone months he won’t meet the target . Nothing he can do about it . At moment we’re in our first year but that will end in summer . Should he ask them to look again ? What happens for others in same position ? Thank you

Hi David sorry just seen the reply . He just needs to be wherever they accept that he does take time off cos he cannot physically do anything . It’s something he’s lived with for years . He’s not getting any younger either. He doesn’t not want to work but he is limited to when he is able . Is it worth asking them to look again ? Thank you for your time .

We cannot answer your question as we do not have all the information to give you an accurate reply as it depends on a number of factors such as minimum income floor, work allowance, do they receive PIP.

you can ask for a mandatory reconsideration, where they make the decision again, I think the normal time limit is one month, but you can still ask up to 13 months later, if you have a good reason, like, I didn't know I could do this (I don't know if they'd accept that or not)
