MR rejected so depressed was created by JLP
I was on enhanced rate for both. At my review I was downgraded to standard rate care and nothing for mobility. I submitted an excellent defence for my MR. It came back as the same. I don’t actually believe they even read it. My report was a work of fiction. How successful are tribunals and does anyone know how long I’ll have to wait. How scary are tribunals? Thanks in advance

I am so sorry to hear about your PIP troubles.
I'm afraid only about 27% of MRs are successful - so I am not entirely surprised to hear that yours was unsuccessful despite putting in a lot of evidence.
Appeals tell a more positive story and currently 67% are successful. The downside is the average waiting time is 52 weeks though it can vary in different areas of the country. I think most people will say that Tribunals are 'scary' because so much is at stake but you do have medical and disability experts on the panel who have greater knowledge than the average assessor. Does everyone have a good experience at a Tribunal? No, but plenty of people still try and many people are delighted when they win. If you can't face a Tribunal panel, you can always ask for a paper-based decision to be made, but success rates are lower simply because the panel never get the opportunity to question the claimant. Please do appeal JLP, there is a good chance when your arguments are so sound, that they will call you to try and cut a deal before it reaches court.
If so, as happened to me, stand your ground and hopefully as I did you'll find DWP have caved in and made the award you know you should get. I found out first after the DWP call, from the Tribunal office calling to say it was lapsed, but they could not answer what the outcome was, I had to call DWP to confirm the award.
If you do get to a Tribunal hearing, remember His Majesty's Courts and Tribunal Service are completely separate from DWP and mostly much fairer. Just remember NOT to dress to impress as this will go against you.
