Change in circumstances after winning tribunal

I recently won my tribunal and was awarded standard for both sections. I provided a lot of information about changes to my health just before the tribunal, which they advised they didn't consider and only based their decision on my circumstances and evidence provided nearly 4 years ago.

I contacted DWP and they sent me a change in circumstances form and said I could just put a covering letter to ask them to refer to the information I provided recently and just note anything that has happened since.

I've done that, but I did not say that the information and evidence I submitted a few months ago was not considered by the tribunal. It just sounded like I'm saying my circumstances have changed since the tribunal.

I've got myself into a complete state about this today, worrying I didn't make this clear and they'll reopen my whole claim and I'll have to go through the entire process again. I've been sick three times this morning just worrying and wishing I had just left it.

My conditions and circumstances the tribunal awarded on have not changed, with one worsening and linking to a long term progressive condition I was diagnosed with last year. But I'm am just so worried my cover letter looks like I'm saying the tribunal considered everything and here's a couple of minor updates from the last 2 months.

Has anyone got any advice, because I'm sat here by myself so stressed I've been sick and can't think about anything else. What is the process after submitting a change in circumstances form? Should I try phoning them Monday to say I submitted the form because some of my conditions and my health have deteriorated since 2023? Therefore were not considered in the tribunal.

I think you are probably worrying unnecessarily as they will have seen the Tribunal judgment and it would have been noted exactly what they did or didn't consider. However, you can't keep worrying about it, so I would ring the DWP and explain that you want a note added to the change of circumstances form. After that phone call, you need to send a letter confirming what you said. (Keep a copy).

Usually, after submitting a change of circumstances form, they usually carry out some form of assessment, which could be a paper-based assessment or a telephone assessment.

Hi Bis,

Thank you for your reply, and I think you're right that I might be over worrying. I'm still decided whether to phone or wait until they contact me, because I don't want to phone and make the situation even worse. I got in a stress and panicked about submitting the form in time and missed some other key information - on the list of hospital procedures/admissions I missed 5 or 6 tests/procedures from the last 18 months off. I mentioned some of them within the information I had submitted before the tribunal, but forgot to add them to the list on one of the front pages.

I don't mind if they review all the information and the award stays the same, but the just the thought of going through it all again is so stressful.

Thank you for replying. I thought I had replied to this yesterday but my message isn't showing.

I think you're right that I might be worrying unnecessarily. I am not good at phoning and do not like phoning when I don't have someone with me to help if I get stuck. And I don't want to risk making things worse if I phone up. So I will wait and see what they come back with now. I got in a panic and paranoid about missing the deadline and missed 5 or 6 tests/procedures off the list of hospital admissions and treatments etc.

The tribunal also said they were not considering any information since I first applied and kept telling me to keep my answers limited to that time. But on their outcome letter is says they considered the appeal bundle plus additions A-M which I think covers everything.

I don't blame you for not wanting to phone the DWP. As long as you're happy with your decision - that's all that matters. Everyone has to do what works for them and their circumstances. Hopefully you will get the positive outcome you're seeking.
