Hi,

Any update on the situation regarding transferring people on indefinite DLA awards over to PIP? My relative is 75 this year and would prefer to stay on DLA given the choice?

Hi queenmalka

The migration criteria from DLA to PIP have nothing to do with whether people have indefinite awards. It is about the age group they fall into. Anyone born on or before 8th April 1948 will stay on DLA. As your relative was born later, there is still a chance they will be asked to migrate at some point. Now, the migration process has been paused and is not expected to start for the majority of those still on DLA until 2028, but there haven't been any recent announcements about it.

I have a Client who is currently on DLA lowest rate and due to reach state pension age in January 2027. Since they first started getting DLA their mobility and health has dramatically deteriorated and I feel fairly sure they would be eligible for the higher rate of PIP under both daily living and mobility. I'm a bit worried that if they don't get an invitation to apply for PIP before they reach state pension age then they will only be able to apply for Attendance Allowance which could mean up to £80 a week less.

Understandably my Client doesn't want to rock any boats, but I'm wondering whether we should make enquiries about PIP before they reach SPA.

Any thoughts would be much appreciated. I'm a new subscriber and have only just joined, but this forum is so helpful!

If you're going to do it, you need to do it now. There is a risk even now that the DWP will play dirty tricks and delay the process and then say they have reached SPA and therefore aren't eligible. Obviously, you would argue that you applied in plenty of time, and some people have been granted, and others haven't.

You're obviously aware that the criteria for DLA and PIP are slightly different, and some people have been disappointed to find that they don't score as highly as they expect. Start the process and do make use of our guide to PIP claims and reviews to help you make the best case for your client. If you already have the knowledge and you don't need the guides do read pages 17 and 18 and the reliability criteria. I've seen too many people (professionals, friends, and family) miss this when they help a claimant complete a form, and it is incredibly costly. Also, pay particular attention to the walking part of the mobility. So many people get caught out by the assessors on it.
