DWP offered lower rate of PIp before date of hearing & my son Accepted as he suffers from Bipolar 2 & was seriously stressed. The letter has arrived but the payments haven’t been backdated to the original date of claim of December but to March, with them saying it’s not payable until June as there’s a qualifying time of 3 months. They’ve also given 11 points on both daily living & mobility so the he’s only 1 point away from enhanced. How do we question this as they say the appeal has now lapsed by accepting the offer but they’ve not backdated it correctly. Do we just have to accept their underhand tactics? Thank you

I'm slightly puzzled here. I understand that they have applied a 3-month qualifying period - which would be March - but I don't understand why your son is not being paid until June. - even though it is paid four weeks in arrears. The three-month qualifying period applies to everyone, but the decision-maker decides how it applies based on what was written, and that can be murky.
Even though you accepted their offer. You can still set up a new appeal, but you can't appeal backdating because that is not part of the process. You could, however, still appeal the points awarded if you wanted to. However, your son by what you say is in a fragile state and may not want to put himself through the process again.
