so if your IB50 is due now but your not in a catchment area or group thats going to be actioned first you could be in for a long wait before you get done.


as for asking for your IB50 to be done now because your last review said they will look again in 5 years the letter 1081/ they send out says

Your case come up for review on date here
we may contact you again after that date and you may be asked to fill in another questionnaire or be called for a medical


so they dont say they will carry out a review just they might


What you say is right, and if IB was going to last forever their would be no problem.
But i believe the letter 11081/ pertains to IB benefit, not some unknown benefit with possible different rules in the future..
TO not send out a IB50 form or a letter saying they have enough information with a new review date, with tho sole purpose of herding claimants onto a new benefit as quickly as possible i personally see as a abuse of power

I've been waiting for 3 months for my review and I am ringing them every 2 weeks to see what's going on. I am told not to worry because the dealy is due to Atos (the people who send out the forms NOT the dwp) are so backlogged because of those who have been taken off IB and out onto ESA or having their monies taken off them appealing the decisions and it is these appeals which are being dealt with first which are causing the problems.

Atos are telling the dwp it is because of the huge amount of appeals against decisions made to move people off IB to ESA which is causing the backlog and therefore no reviews being made because of the enormous workload and nothing else. Are they lying? you tell me?

Hi Silver Shadow,

In my opinion, and from the contacts I have, both reasons are correct. ATOS have a backlog in sending out IB/ESA 50 forms, and I know that the Tribunals Service also have a backlog in arranging appeals mainly because of the large number of appeals in respect of IB/ESA.

All decisions on reviews have to be made by a DWP Decision Maker, and they also are overwhelmed with their workload due to staff cuts or being moved to a different office.

In a nutshell, the 'system' is in chaos and close to 'meltdown' as I'm sure other moderators would agree.

What a shambles for the coalition government's future plans.

Once your review date is flagged up on the DWP system,your details are then sent to ATOS.
It takes no time or effort whatsoever for ATOS to send out/post a form.
This is the 21st century after all.
Most legal people i know believe they/DWP/ATOS are playing games
The DWP has no intention of awarding 2/3 years awards to currant claimants, or getting involved in IB appeals
