Hi incap99

There is nothing wrong in making a complaint but if your benefit has been sanctioned you need to consider appealing.

You need permission from JCP or the provider to defer an interview, but if they say that you didn't have good cause for not attending and you disagree, this can be challenged on appeal. You can talk to a welfare rights advisor about this.

so the manager rang me, who was quite concerend about my complaint, the main issues were:

1 letter addresed to me, but called somebody else in the letter.

2 adviser failed to take notice of the reasons i could not attend.

3. the amount of the sanction.

4, some other issues

the manager said she would look into this and would call me back within 48 hours

2 days later after i called her, i found out i had not been paid on the normal day im paid, i went crazy with the anger and stress, i rang my adivsers number and tthe same person who passed my complaintto the manger anserweed the phone, i admit i was extemly loud and shouted at this person down the phone.

now in the earlier letter they sent me the date the sanctions were to start were still days away, so they had stoped my benifit before the day it was supposed to be sanction, and it was not ment to of been stopped it was ment to have a deducton took off it (more clear cut maladministration)

so i was going crazy down the phone at this person demandin to no where my money was etc, i told him i was getting my shoes on id be down to see him.

in a fit or uncrontrolable rage and with my temper at a sky high level i stormed off to the office where he was based. things go quite wrong in the office as i start shouting at this guy everyone is looking and security are behinde me as i follow him to his desk, i sadly make no appology for dooing this.

at this time i get a call from the manager, which calms me down.

the manager informs me that none of this should be happening to me and errors have been made, she told me that i was quite right that my benifit should not of been affected until the sanction start date, (turnbs out they had sanctioned it nearly a wekk before it was due to be sanctioned) she said my money would be in my back that night (which it was) but the deduction would of been took, because of how late the payment had been sent, and she was still looking into the cae and not finnished yet.

i got up and left the office saying some nasty stuff as i left the building.


more to follow, im not even at the most shocking part yet

a day after my partner gives me the phone and the manager is on the phone.

this person is quite a nice and caring person and i find it easy to remane calm and talk to her, she agrees that my benifit should not of been stopped, or indeed of had any sanctions imposed, taht yesters kick office in the office should of never happened, and would not of happened had the advsor took me more serriously, and she had a counter payment for me for the missing amount of money, she asked if i would come down and see her if i would stay calm - i reluctantly agreed.

so i get diwn there and 2 security gurds rush to open a private room dooe, me and the manager enter this room.

basically, she appologises agrres with my compalint 100% multiple errors all on there side and i should of never of been put trhough this.

now the bit that follows is either me been paranoid or i am right with what im am going to say next.

so i am in this office with this person who is appologsing etc

she keeps stating that these interviews can not be waived that "they" took the right away from the advisors to do this and it can only be deferd.

she says the staff member needs who wrote the apointment letters needs help with his customer skills and will be coached wot ever that means, and his letter writing is bad,

now i think im there for my complaint and this is important, she also takes about voluntry work and help looking for work, mentings things about £40 per week if i get a job.

the meeting ends and i am handed a giro check for the sanctioned amount from my benifit, she also gives me a booklet "pathways to work" once again telling me the sanction has been lifted.

i told her that for piece of mind i was going to ask for copys of all data and audit trail, she replied that she could show me everything and anything they hold about me on a computer outside.

i also told this person that i would get to see all emails and notes etc that they had sent between each other talking about me etc.

no formal record of my complaint has been lodged there is nothing on paper about this complaint.

no theni dont trust the dwp at all.

i can not get it out of mind that under the guise of my complaint been resolved in this room, she has infact very clevery subject me to one of thes work focused interviews without me knowing, the £40 a week thing, the voluntry work the booklet - you see where im coming from??

whos to say that this sanction has been lifted not because of my complaint but becasue she has actualy managed to interview me in line with this interview

the more i think about the more it was like a work focused interview, only her and her 2 underworks no about my compalint.

i would like all your views on this, is it possible that my formal complaint has been brushed under the carpet, and they tricked me into having a so called meeting about my complaint when infact she has wfi<ed me

i hope every one can understand how serrious this would be if this is what has happened.

im going to find out officaly, who put the sanction on my benifit and for what reason, and more importantly who what why and when and for wot offical reason was this sanction lifted?

becuase if this person has tricked and decived me like this then i will not be a hppy man, this whole epposide has servely affected me i dont no if im coming or going and im seething in more anger and paranod becasue i now have no idear what they have done to me

alarm bells rang as i knew she was not able to do this as paper records are held in storage.

can i ask for some views on this:

is it:

1. the sanction was lifted because it was uncorectly applied

2 or have i been cheated and had one of these interviews in a sneakaly underhand maner

3 my formal complaint has been side steped, and should of been investigated at a higher level.
