Missing information from subject access request

Although there is a few days to go before the 40 days limit on the SAR I submitted to the LEEDS benefit delivery centre expires I have a couple of questions.

I received a very large pile of papers from the benefits office I last signed on at and on looking through them the decision makers score sheet for my medical in May is there but not the report itself.
Before putting in the SAR on paper, using this form , there was 2 requests made by phone for a copy of the report the first one on 1/6/10 and the second, I think, about 12 weeks later on 25/8/10

The covering letter says that they had no information about any Incapacity benefit claim but include a medical report from march 2008 along with the papers to the tribunal I attended.

The DLA paperwork that was also requested hasn't turned up, I can remember having to get a solicitor to write to the DLA department for some reason or other as the ex had done something and the DWP wouldn't allow me to change it to my bank account or claim any benefit in my own name, so I don't know if this may cause a problem in getting copy's of any information the DWP hold about me regarding DLA as my present claim dates back to when I was still with my ex.

All the information was put into bundles and each separate part was held together with an elastic band,so I don't see how they could have lost the recent medical report, I am beginning to think there is something in the report that the HCP has written that they don't want me to see

I remember I posted that I had sent in the SAR form and received a one paragraph reply. When I sent the Leeds BDC an e-mail complaining of the reply I then got 2 phone calls from the DWP, I didn't answer them, I was then sent a letter saying the person who I had received my complaint did not have a copy of the SAR form and wanted me to send the form to them I don't know how long they will take to, as they say look into it. I sent the BDC a copy of the SAR with what had been written plus a copy of the letter I was sent asking for the form, just so they knew who had requested the form.

The questions I hope someone can help with are:-

1. Should the medical report have been with the decision makers score sheet or is it common for the DWP to leave out information in the hope it won't be seen when a request for a lot of information is made

2. How long should it take the DWP to find out who filled in my SAR with 1 paragraph telling me to basically phone for information about what I had requested, and am I entitled to know the outcome.

3. After a quick search on-line it may have been that my ex made herself my appointee, or something like that, so would the DWP (DLA) have to give me copy's of the information that she had filled in and claimed to be my appointee.

To answer you questions in depth would require someone fully qualified in Data Protection/Information matters.

lost papers ? the DWP could have put your papers in a safe with an armed guard and still lost them a rubber band will not keep them togther, good chance thats a bigger rubber band than the one they started with and put that one on when the last one broke and they lost some papers :)

put in another request and ask for the misssing papers they then would look to see if aything is missing and if they find it they will send it, if they write and say they have no more

that means in English they have lost papers :)
