Hi Mike.
You do not need to have a job to be in receipt of ESA (Income Related).
The wording can be deceptive, the fact that you have no income and have not paid enough NI contributions is the reason you would qualify.
That is of course assuming you pass the WCA (Work capability Assessment).

OK, the first thing to say is that you do not need to be working to receive Income Related ESA, so you don't need to worry about that.and what happenss if i dnt meet any of this criteria will i have no benefits cos i need benefits to survive and how do u fail a medical tesst,and i wont be moved onto income based esa as i do not have a job

If you fail the medical, you can appeal if you want, but if you don't appeal, or if you appeal but your appeal is turned down, you won't get ESA.
You could apply for JSA and look for work. Depending on your personal circumstances, you might be entitled to other benefits, such as Carers Allowance if you are looking after someone else etc.

It's worth pointing out that when you claim ESA assessment rate pending appeal, you do not get NI credits. These will only be reinstated if the appeal is allowed.
In other words, you have to gamble with your NI credits for the right to appeal.
