on IB since 1990 and needing help was created by julie
Hi not sure if anyone can help me I have been on IB since 1990, as I have had renal failure since childhood, and after working in my teens and having very bad health, when I was transplanted for a second time in 1994, I have never been able to return to work.
In all that time I was only ever called for a medical once( when I was 18 ) and then 3 years ago( when I was 39)
3 years ago I scored zero points, and then on writing a letter to my local DWP office, I was awarded IB on " non functional descriptor" I was sent a letter and it says;
People with certain disabilities or severe illnesses are treated as meeting the threshold of incapacity and do not have to undergo the assessment.
Because you have one of these disabilities or illnesses you can be treated as meeting the threshold of incapacity.
My question is, what will happen to me? will I be called for a medical? and if I am will I be able to fight on the same grounds as I did 3 years ago. And as someone on IB for so long I am do not pay tax on my IB, and all it says online about this is that they have not decided what to do with people on this type of IB.
If I do get ESA would it depend on how much savings I have? or income comes into the house

Nothing on this board constitutes legal advice - always consult a professional about specific problems

I am afraid, whilst there are some exceptions to ESA, renal failure is not one of them. so you should expect to assessed to one degree or another.
I would suggest you read the Understanding ESA guide, to get an idea of the process and what the criteria for the two tests are.
As you are on IB, you would be transferred to Contribution Based ESA. This is liable to tax but does not take into account your savings.
It is expected that ESA(CB) will be limited to one year for members of the WRAG (not the Support Group) after which you could be eligible for Income Related ESA. ESA(IR) is not liable to tax but is means tested, taking into account you amd your partners savings (£16,000) and income.

Hi Julie
I got exactly the same letter, after fifteen years of them sending me forms the penny dropped... it ain't going to get any better. Howerver, it looks like we're back to square one with ESA.

Thanks for that Gordon, I understand that most renal failure patients would have to be assessed, I think I was awarded before as my original renal failure is due to a complaint that re occurs, in transplanted kidneys( and was the cause of my first transplant failing) I say I assume as the DWP have never really clarified this to me.
I think I will have to take the wait and see approach, as I have read through all of the stuff on the subject, and still do not understand what I will be entitled to, I guess probably nothing--- just months of stress and worry
