As you point out this is not currently legislation, however, there is an expectation that this will be passed into law.
The current intention is that the one year rule will come into effect in April 2012 and will retrospective, so anybody receiving ESA(CB), who has already been in the WRAG for a year, at that time, will be effected.

I totally agree with you, none of us can afford to lose our ESA. Your are a victim of benefit bashing hysteria.
I unfortunantely don't believe the system works in our favour, they want people like us, to lose what we are entitled to.

Having now lost my child maintenance, I too am really worried about loosing any ESA.
If I fail my next WCA, what happens financially?

I am holding your post pending a decision by the site owner, I do not believe it is appropriate for members to share details of their ESA50 content through Benefits and Work.

Hi All,
While I do understand it is done with the best of intentions, we can't allow offers to share completed ESA50s to be published on the forum.
It's absolutely vital that people complete their claim pack giving detailed information and examples from their own life.

Hang in there: it hasn't happened yet, and it may all go well for you.
If the absolute worst happens, you would presumably appeal, and would be paid at the assessment rate until the appeal is heard, so even in the worst case, you wouldn't immediately lose all your money. If you are on income-related benefits, all your premiums will continue to be paid whilst waiting for any appeal too.
But think positive: you are super-well-informed on how to deal with the system, fill in the form, etc, and there may be no need to worry. (Of course that's a lot easier said than done!)
