Hi I have just seen your enquiry. I myself was in support group from 1st Appeal and this was subsequently downgraded to WRAG as a result of 2nd ATOS Medical. I appealed this decision and was due to go to appeal today. But to my suprise I received a phone call this morning saying I did not need to attend as Judges had read my appeal paperwork and decided in my favour thus re-instating me into support group. So in answer to your question yes it can happen. Good luck on 15th and hope that your Judges may also have the common sense not to require you to attend. Carol

people are being "downgraded" from the Support Group for idealogical reasons, its all part of the big moneysaving scheme being played out.
I didn't even bother appealing being placed in the WRAG, as i have no faith in the system.

Sorry for the brain fog, but why is this persons esa ending in april 2012. Is this something to do with the
one year rule, as I thought this was not law yet.

As you point out this is not currently legislation, however, there is an expectation that this will be passed into law.
The current intention is that the one year rule will come into effect in April 2012 and will retrospective, so anybody receiving ESA(CB), who has already been in the WRAG for a year, at that time, will be effected.

Hi Ranald, if it weren't for this new rule about only getting contribution based ESA for a year coming into play, then nor would I be bothering. However, I can't afford lose this money so I have no choice.
