On my original DLA award it states "For Life"

Hi, Rob

I can understand how angry you feel. You were apparently made a promise, given a guarantee of a certain amount of income you could rely on. That's such an important thing when sickness or disability has reduced your strength and abilities. Now that 'promise' has been broken.

However, as several people have pointed out, the government can change the law in ways that makes old decisions no longer valid. And that's what's happened to you. So the best advice I can give is (a) do whatever you need to do to get over your anger and (b) get the best advice available on how to claim successfully the maximum you can under the new regulations.

Tempting as it might be to sue someone, it's extremely unlikely to succeed and will just cause you lots more stress and heartache!!!

Best wishes,
Andy.

Following on from this discussion I was drawn to the indefinate DLA, I was awarded the highest rate last month, what does this meen for me? will I get DLA indefinately, or is that going to change?

The Government have said that with the intended introduction of PIP from 2013, they intend to re-assess everybody, so I am afraid, at some time in the future, you should expect there to be some form of re-assessment, when that will be and what form it will take is not clear, beyond that which is included in the guide to PIP that is available in the Members area.

Michael and all

Even if there was a case regarding some form of broken contract, which I don't concede, such an action would strike at the very roots of the Social Security system in the UK, and as consquence would undoubtedly be appealed, if necessary, to the European Court.

Such a case would take years, and would cost £100,000s if not millions, if anybody here has that sort of money, I would ask, why are you hanging out with all us guys on benefits?

Yes your right all it takes is for good men to do nothing for evil to succeed.

I'm sure the miners should of done the same regarding their compensation health claims.

No I don't have that sort of money but somebody in a similar position might qualify for legal aid ???
