Firstly I too have fibro so i certainly know what your going thru and how damn frustrating it is for others to not understand whats wrong and how easily you can hurt for no reason and awake one second and the next feel like you are going to pass out with fatigue
I went on Incap Benefit in 2008 and had one medical and then interview at job centre and nothing else since so waiting for brown letter to drop thru my letterbox re ESA
Sorry you have been thru all this and lost, keep appealing even tho is tiring and debilitating especially when you have upheld a difficult physical job for all your life and now the simplest task is really hard.
Do you get DLA? please apply if you dont and list every detail about how fibro effects you..i have 4 1/2 year old twin boys and i am unable to pick them up due to weakness, i cannot prepare a meal despite trying every different peeler, perching stool etc...as for sleep - my fibro specialist got my gp to prescribe melatonin - they are herbal type and usually used for jetlag, they help relax the body and help aid sleep - they help to some extent so can sleep about 3 hours without being disturbed etc - also taken with tramadaol, citolpram....
havent done the tribunal thing but just wanted to say i understand and sorry waffling another fibro thing to have hit me......

Hi Paul, I too have Fybromyalgia, I have been on Incapacity Benefit for 5 years I applied for DLA and was turned down twice, I appealed and was granted the the lowest rate of care for 3 years. The appeal took almost 12 months to complete during which time my health deteriorated. I agree that nobody seems to understand Fybromyalgia, I am tired of having to explain and justify myself to people that just don't seem to listen or care. I had the same experience with the Atos doctor. My partner mentioned that we sometimes go to Ramsbottom in the car where I can sit in the car and watch the Steam Trains while my partners does some shopping. The doctor wrote "goes to Ramsbottom shopping" a completely different interpretation to what was said, he also said I found it difficult to bend down to my oven, I have and eye level oven!!!! Its very distressing to keep getting kicked in the teeth and you have my sincere sympathy, I echo what others have said, get as much info as you can from this website and apply again, good luck

Oh and thanks to Shrimp for the info, I have not heard of melatonin, and am going to look into it.

Hi Gordon, Please excuse my ignorance but do I wait for the decision to come through from the tribunal in writing before I submit another claim for ESA Can I submit another claim forESA? This is driving me mad at the moment. Thanks for all your help Paul

Hi Queenarc

It's not necessary to wait for the tribunal's decision notice. You can make a new claim for ESA straight away. Provided six months have elapsed since the DWP decision that was under appeal your entitlement to ESA at assessment rate will continue.

If you have already submitted a sick note with your old claim it may cover your new claim but I suspect the DWP may ask you for a new sick note.
