It's not unusual for a claimant to fail the WCA with a prognosis: a return to work can be considered in three months!

Most people would consider this a blatant contradiction. Perhaps the DWP are accepting that people who can't work will fail the WCA and claim JSA.

Thanks for that Derek, I wasn't aware of that scenario, I thought a prognosis was only given if ESA was awarded.

Still think Joan needs to get exact answers to the questions I posed though, she seems very confused.

It will be interesting to know from PCA exempt claimants if and when they are migrated to ESA from IB, what date the ADA will record for an anticipated return to work?

Given the fact that many will have been PCA exempt since the inception of IB in 1995, how could it then ever be justified that these claimants could be considered for example, a return to work within say three or six months, when they may have been found incapable of work by the DWP for sixteen years or more?

Hi everyone! As you know i have been onto the forum recently totally confused about 6 points at esa medical, medical saying fit to return to work in 3 months and no paperwork from DWP giving me any explanation but a phone call from them asking me to forward letters of support. Firstly i made an error in saying that they asked for letter of support from CAB, that was my mistake when typing as they didnt it was support letters from doc and psychologist only...sorry! CAB done out a letter for me and all 3 were then sent to DWP which seemed to be a reconsideration as no GL24 form was filled in or asked for. I have also been on DLA since 2000, high mob and middle care and was shocked when i got 6 points as i have been ill for sooo long. RESULT.... phone call today from DWP, decision overturned, entitled to esa (although my money never changed over these last weeks whilst this was going on) placed in WRAG group for a year and then will receive another form! Yipppeeeee, but still feel i should have been placed in support group. Now i have this forum and help at hand i will feel more confident should anything else come up. Many, many thanks for all your help moderators and friends. :cheer:

Joan, I'm really glad that you have some clarity now on where you stand with your ESA award.

Thanks also for coming back and letting us know.

You say that you feel that you should have been put in the Support Group, if you wish to appeal this decision of being put in WRAG, don't forget you only have a month from the date of the WRAG decision to submit your GL24 appeal form.

If you did this, you would continue to receive the WRAG rate of pay, either up until the decision was changed at the automatic reconsideration, or if not at that stage, right up until the date of your Appeal Tribunal Hearing.

It is of course entirely up to you, whether to appeal for Support Group status, just thought I'd remind you of the month deadline.
