Hi all.
I recently sent back my yearly ESA medical form. On the part where it asks you if there are any dates where you cannot attend, I stated a few weeks where my friend who is bringing me is working away and therefore cannot bring me. I have mobility and mental health problems and I cannot travel alone. I also live alone and away from the area where I am origionally from and this makes getting someone to help me very difficult.
I explained all this in the medical form (which I have copies of) and ATOS called me up to book an appointment. They noted when I was not availible and said that was fine, and asked that I call them back in two weeks time to make my appointment, which I did, but when I called, they told me that they had returned my paperwork to my benefit office. They told me this was no problem, and that all I had to do was call my benefit office, explain the situation and that they'd return my file to ATOS.
Since then, I've recieved a letter from my benefits office claiming that I had made myself unavailible for my medical (even though no date was given) and that I need to call them an explain why. Again.
So I called them and explained and the operator told me she'd send an email with the details. This was on the 15th and I've now not had any money for 2 weeks.
I've called them since and been told that 'someone' is dealing with my 'excuse' and that someone would be in touch with me within 5 working days.
I'd call them again, but since they've suspended my benefit, I can't even top up my phone to call, or get out to a jobcentre for help. I feel like a prisoner at the moment, and unsure of what to do. Has anyone else experienced this?

As the DWP have terminated your ESA award because of your alleged non-attendance at a medical assessment, you can appeal this decision.

I am unaware of the contents of the letter you received from the DWP, but it should explain your right of appeal? If you fail to attend a medical without good cause, you will be treated as not having limited capability for work and as such you will not be entitled to ESA. In deciding whether you have good cause, the ESA decision maker must consider all the circumstances. Virtually any reason can be considered as good cause for non-attendance.

If your benefit is not reinstated because you are considered not to have good cause for failing to attend the medical, but you think you did, you should also make a fresh claim for ESA as well as lodging an appeal.
