I was asked this question today, considering I am in constant pain 24/7/52, only the degree of pain varies.
Could it not be considered a breach of the Human rights Act to force people who are in in physical pain due to identifiable illness (medically recorded) into situations where they could be at risk of suffering furhter pain and damage to their bodies?
One other question was raised - How do people with know health problems actually get anyone to employ them in the 1st instance - they would have the Health and Safetuy at work regulations to deal with and their Employment Liability Insurance. If we actully had an accident - in my case, I was to blackout (which happensd 2/3 times per week) would the insurance payout and who would be cualpable for causing the accident in the 1st instance?
