It may say on the short decision notice from the tribunal that Schedule 3 is satisfied (WCA prior to April 2011), or that Schedule 2 is satisfied (WCA post April 2011).

Oh dear here we go again, sorry if I am boring you all with my moaning and whinging.

Been to Jcp this morning to take tribuneral decision paper for ESA to be faxed to Glasgow, while there my partner told then his payment had not gone in the bank today and was told that his claim had been cancelled because he hasn't sent in a fit note! he's been placed in the support group so shouldn't need to send one in sighhhhhhh!
He has been told he needs to reclaim what the hell do they do all day in the DWP?
We asked to see a complaints manager and was told their isn't one on site.

I've phoned our MP and she is going to look into this.

I'm just sick of the whole thing now.

Thanks for the support I get here, I come here for some sanity :-)

What the DWP have told you and your partner is complete nonsense.

Now that your partner has been placed in the support group by the tribunal, there is no requirement to submit any further medical certificates, and if the DWP had got the decision correct from the outset, they would have been obliged to have made it known that once the WCA had been carried out and a claimant is placed into either the WRAG or support group, that medical certificates are no longer required. This is a fundamental procedural issue.

It appears that the DWP in the absence of the notification of the appeal success, have taken it upon themselves to consider that through not providing a medical certificate you partner has defaulted on his obligations during the appeal phase of his claim, which of course has now been decided in his favour.

This is certainly a matter for your MP to take up, who will be dealing with a senior officer in relation to the complaint, so hopefully dealing with the organ grinder rather than the monkeys, will finally elicit some positive and expedited action in your partner's case?

Hi Gordon here is exactly what it says on tribuneral notice:-

Decision notice.

The appeal is allowed.
The decision of the secretary of state issued on 4/8/2009 is sEt aside.

Mr M is entitled to employment and support allowance (ESA) with the support component

The descriptors is satisfied in shedule 2 ESA Regulations are 1(e) -6 points,3(c)-6 points,2(e)-6 points.

The descriptor satisfied in shedule 3 ESA Regulations is:-None.

Am I missing something?

I called esa again today but once again only got through to national call centre, cant get through to anyone we need to, like hitting a brick wall.

Called MP today and her secretary informed me they are far to busy with more important things to deal with right now and will look into it soon?!?!

Waiting to hear from cheif exec re my complaint, but don't hold out much hope.

Complete nightmare the whole thing.

Thanks for posting the extract.

The letter is poorly worded, however, based on the contents I would have to say that your husband has been placed in the WRAG.

Schedule 2 refers to the points based criteria of the WRAG, he has scored a total of 18 points, 3 more than the 15 points required for the WRAG.

Schedule 3 refers to the Support Group criteria, according to the letter he has not met any of the criteria.

I can see where the confusion has come from, but I think the DWP have called it correctly.
