If appealing to bein Support -no interviews needed

I found out that after being placed in WRAG, but with an appeal to be in Support, it is not compulsory to attend JC+ interviews as there is a rule that because you are appealing to be in Support you do not need to attend.

This is a nice find!

Hi ll,

We've have had discussions re : this issue before.

I thought the same as you, that if appealing WRAG to support, you did not have to attend WFI's works programme, etc.

However I think it was Derek or Gordon, who said that they could not find any regulations stating this.

We then referred to a querie on Rightsnet, and were made aware that this "Exemption" is only classed as Operational Procedure, and could therefore vary from one Benefits Office, to another.

Have you actually found "Regs" that cover this scenario?.

I was told this by my Personal Adviser at JC+. I received an appointment in the post, phoned to change the timing, and as a result of our discussion the adviser told me I did not need to attend any as I was appealing to be in support.

If there are regs. out there it would be brilliant if someone could find them.

Hi Lisa
I would suggest ask your JC+ adviser to put her verbal advice to you in writing. Your Benefit Delivery Centre may disagree with the advice given by your JC+ adviser & if there is nothing in writing to back it up & you miss a WFI you may be regarded as being uncooperative & in danger of losing your ESA.

The requirement not to undertake work-related activity whilst appealing a decision not to be placed in the support group was notified in a DMG memo, but like Derek and/or Gordon I am having great difficulty in locating the actual memo in question.

I will keep on trying to find it.
