No it's not law yet, but there seems little liklihood that it will not be.
In order to claim ESA(CB) you need to have earnt enough qualifying NI credits in the designated tax years, you can't do this without working.

Can you not have earned NI credits whilst in receipt of IB and therefore be placed on ESA (CB)
Hi, as Gordon says, the only way to gain the NI credits that would allow a re-claim of Cont/ESA would be by working.
IMO, this is one of the reasons for this change in qualifying criteria.

I have but assume that will change to 66 as the retirement age for women does. It sure won't be much as I left in 1980... gosh a lifetime ago. I used to climb cliffs, hike miles and jump out of helicoptors [for fun LOL] ha, now I struggle to get from one room to another in our tiny house and have to lie down when I make it. the stairs are my cliffs now and take much longer to climb... painfully... and have to lie down again... oh I wanna be ME again.
You can apply for a valuation of the pension and if you pass a medical or even just supply a letter from a dr saying you cant go back to full time work again you can claim your pension if they agree you will get a lump sum of three times pension and the pansion paid going up each year by CPI in september

oh and then we could afford to get the care alert thingy so I can get help if I can't get up after a fall :)another worry off hubbie its not much a week but there's nothing left to give up

THANK YOU soooo much. I am shaking now for a hopeful reason as 3 times what it says on my discharge papers would still be enough for a second hand stairlift 1 big worry off hubbie

the amount of pension it says on your discharge paper has to be re calculated and increased by the RPI in september each year up till last year then onwards by CPI
IF and only IF they agree with your medical evidance they can award you a pension NOW..... I helped someone on here last year I thin get it and of course I myself claimed my pension early on ill health grounds it can take from 3 months to a year and the date they start paying from is one they make up In my case it seemed to be half way from when I asked to the date they started it so I got 4 months back pay and 3 times pension lump sum
the other thing is you might get help from RAFA and British Legion as an ex services person they will help you if they can
