ESA APPEAL was created by clio
Hi
I have been put into the WRAG group I feel i should be in the support group.
If I appeal do I have to go to a tribual hearing?
or do I ask them to reconsider my application?

You can either ask for a reconsideration or appeal straight away. If you appeal, they will reconsider your claim anyway.
If you appeal, it will go to a tribunal, but you will be offered the choice of a paper appeal, so that the tribunal can consider the case without a hearing. By and large, people who attend a hearing stand a better chance of success on appeal, but this is only general and may not necessarily apply in your case.
Do read our guide to appeals.
Good luck.

Hi,Clio, this is covered in the Appeals Guide.
Go to the members area here: www.benefitsandwork.co.uk/help-for-claimants/esa and click on link: "Employment and Support Allowance appeals" (35 page guide)
Good luck if you do decide to appeal.
Andy.

Hi Clio
You should send any information to support your claim when asking for a reconsideration but you should also consider appealing instead, as the reconsideration will take place anyway prior to appeal. There is no obvious advantage in asking the DWP to reconsider.
Also bear in mind that there is a risk (probably minimal) that you could lose the award that you already have. Please see the guides for more information.
Good luck
Derek
