When to start claiming ESA? was created by helen
At what point is it possible to start claiming ESA please?

Is it when SSP runs out or when you receive your P60 or some other time?

Hi Helen

You are not entitled to ESA while receiving SSP so I would presume you can make a claim when SSP ends.

If you know this date you can usually make a claim up to three months in advance.

Hi Derek,I am interested in your reply to this. I am currently getting sick pay but have been given notice of dismissal due to long-term illhealth (all done correctly, so no comeback). Does this mean that I can start a claim for ESA before my employment has actually ended?

Yes you can initiate a claim ,and enter the assessment phase of ESA whilst still officially in employment.

It is around a 13 week process, look in the ESA guides of the orange MEMBERS ONLY area on the left for more information.

OK, now I'm totally confused!
I have been off sick for more than 40 weeks and am now getting half pay (I know,I have had a very generous amount of paid sick leave!). According to direct.gov,it seems that SSP is payable for only 28 weeks and, after that time, my employer should have given me form SSP1 so that I could claim ESA. My manager is new and is learning as she goes along, as am I, I doubt she has even heard of an SSP1.
So, what happens next? Should I ask for the SSP1 and start the ESA claim, or should I wait until my employment, and pay, has finished?
I'm not trying to claim ESA while I am still being paid, just trying to get things lined up so that I am not totally without income when my job finishes!
