if you're able to secure legal representation at an esa appeal tribunal, do you the appellant HAVE to speak, or can you leave it up to your solicitor?
just how advantageous is it to be legally represented please?

Hi Petrocelli
When represented at an appeal tribunal, the tribunal will still direct questions to the appellant, because only the appellant can answer specific questions about their circumstances.
A rep can offer assistance and statistically appellants have a substantially better chance of success if represented, although I don't recall of the top-of-my-head what the percentage is.

Hi Derek,
Can your rep be a family member that is also a solicitor, but only representing you as a close family member rather than the later, or are they obliged to tell the tribunal of their proffession.

When you say 'as a close family member' do you mean attending as a witness/companion as opposed to a representative?
If you are represented at an appeal tribunal it's important the your rep is familiar with benefit law. It's fine to have people accompanying you for support, or as witnesses who would like to speak, but you don't normally call them representatives. I don't think you need to inform the tribunal of the professions of companions/witnesses but they may ask.
Jim's an experienced tribunal member so he may be able to give you more information of tribunal procedures.
