DLA payments when moving abroad was created by Shirley
Hi, I have been in receipt of the middle rate DLA and lower rate mobility component for approximately 4 years (successful claim down to the Benefits and Work Guides).
I wonder if its possible to clarify the rules regarding claiming when moving abroad. I moved to Spain 6 weeks ago and notified all the correct agencies as I should. I knew that the mobility component would be withdrawn once I moved but was surprised to learn that when moving abroad your entitlement to DLA will only continue if you or your husband/wife have paid National Insurance contributions in the relevant tax year, In my case my husband has paid full contributions until December 2012 so my DLA is to continue temporarily but is likely to cease on the 4th January 2015. Can anyone please help or advise as I had always believed that DLA was a non-contributory benefit?
I am very lucky in that my live in carer has also made the move with me but I understand her carers allowance would also cease when my DLA does.
Can anyone confirm if this is correct or if its possible to mitigate under these circumstances.

You can continue to claim Disability Living Allowance (care component), Attendance Allowance and Carer's Allowance from the UK once you move to Spain as long as can prove that you have adhered to the following conditions:
• That you have paid national insurance contributions in the UK because of your work or you are a dependant family member of someone who does.
Or...
• You are eligible to receive a UK State Pension, Bereavement Benefit or UK sickness benefit.
Or ...
• You are a dependant of someone who is eligible to receive a UK sickness benefit.
And...
• on the date of your claim, you had spent 26 out of the previous 52 weeks in the UK.
For more information you should either visit the Department of Works & Pensions website or contact the Pension, Disability and Carer’s Service (PDCS) at This email address is being protected from spambots. You need JavaScript enabled to view it.
Once you have confirmed that you are eligible you will also be able to proceed with any application through the above contact.

Many thanks for your quick response and Webb link. I've had a look at the link and it seems to confirm that NI contributions are required in order for my claim to continue. It just surprises me as the same rule does not apply in the UK?
