DLA Tribunal in my favour but will the DWP pay out was created by fionaf
quite shocked that I won middle rate care component, and lower rate mobility component after so many years . It is back dated to Sept of last year . This words out as thousands. I can't see the DWP paying this much. Can they refuse to ?

Hi ff,
Congratulations on winning your DLA appeal !!!
As the Tribunal's decision is back dated to the time of the adverse decision appealed, you will be entitled to back payment of any arrears of DLA owed to you from that date.
It is quite par for the course for successful appellants to be payed several months of back dated benefits, as tribunal hearings are taking so long after appealing.
To speed up the process, you could send a copy of the tribunal's decision notice to the DLA unit, when you receive it.
Sending Documents to the DWP or ATOS

Congrats
I was told you could call the DWP and ask for a schedule of the payment so that they break down how much for each payment and from when each class of payments changed rate i.e. the rate go up usually in April, if I am correct.
It's good to do a rough calculation and then see what they come up with. I was told the DWP sometimes gets the calculations wrong i.e may add up the wrong number of weeks at the wrong rate and the schedule will show this.
Best wishes

Hi ff,
A good suggestion from DT.
You can do a rough calculation by reviewing the FAQ below :
Benefit Rates 2012
It includes the 2012/13 rates, and the current 2013/14 rates, so from September 12 until around April 8th 2013 will be at 2012/13, then from April 2013 to present at 2013/14 rates.
Once sorted out, it should appear as a lump sum in your nominated bank account.
