DLA/PIP Refusal after terminal illness diagnosis was created by Bogwart
I was diagnosed with a terminal illness in July. I am in receipt of an indefinite award of DLA lower rate care, and have been for several years. They turned down my claim for mobility and I didn't want to take a chance on losing both awards. I am now 67.
My hospice specialist nurse prepared a DS1500 form and sent it to DWP. They awarded me the higher rate care fairly quickly, but blanked me on the mobility component, saying I didn't meet the criteria. But the only times I have left the premises in the last two years have been in an ambulance going to hospital, and I rely totally on a frame to get around my flat.
Further questioning by the hospice produced the answer that I was entitled to HRC OR HRM, but not both. This seems extraordinary to me and I was hoping someone here might have some experience in this field and be able to give me some advice. If that IS the rule then so be it, but it seems to me that their prevarication, their arbitrary and capricious way of dealing with this claim, militates against it.
I look forward to hearing from someone more knowledgeable, and thank you in advance.

There has been some misinformation, but the end result is the same, I will try and clarify the situation for you.
I assume you are receiving DLA.
Only the Care component is awarded when their is a DS1500.
Mobility can be awarded if the claimant meets the requirements for either the Lower or Higher levels, however, a new claim for Mobility cannot be made after the age of 65, which I would think is the actual reason that you have been turned down.
