Mandatory reconsideration was created by Lorraine
I received my mandatory reconsideration response, they refused to change the decision. I did not receive a phone call prior to me receiving the decision letter. Is this correct or should I have had a phone call?

Hi Lorraine

You are not alone in receiving the same result for your MR, I would say that at least 70% of the MR claims we do result in the same decision, which we then take to appeal.

When it goes on to appeal, 99% of our cases are successful, in fact I can only remember loosing one case in the last 12 years and that case I believed we should have won but it was the start of Covid.

Some claimants receive a phone call at MR stage many do not.

I know members on the forum will tell you their story.

Thank you for your reply. I will go to appeal. The reasoning was so wrong and quoted something I did not say, I have all my paperwork and have gone through it carefully and 100% did not say what he is claiming. Can I ask for a paper tribunal or is it decided by the tribunal. I’m in Scotland. I’m disputing the planning and following journeys under mental health grounds. I have functional neurological disorder, this cases my legs to give way without warning I sent my consultants report confirming that going out causes me significant stress.
Is this sufficient to award me any points for planning and following journeys? Your thoughts would be very much appreciated

Hi Lorraine

One of our new mods is based in Scotland so can put me right if what I say is incorrect as it may be slightly different.

You can appeal on line, I did one a few months ago and found the process very simple, one thing I would say to you before applying on line is complete your submission in either a word doc or using notes depending on which system you use. we do have guides to help you complete a submission.

As you complete the online form it does as if you want a paper tribunal, if you tick this option then they will only look at the supporting documents supplied to them and you will not be able to have an input.

To answer your question you need to read the descriptor in our guides, as I do not know you, I cannot answer your question. Do a day diary for at least a week setting out how your condition affects you on a day to day basis, warts and all, and what help you need and why, this can have a lot of clout at a Tribunal.

Hi Lorraine

The last one I did, completed the on line appeal form beginning of August, the Appeal was heard in October, about 6 weeks in total.

On the forum time varies from members from a few weeks to many months, it also depends on where you live.
