The question is about continuation of Contributions Based ESA and in your guide it says:
"However, if contributory ESA claimants wish to claim help with their rent or become
responsible for children and previously would have claimed Housing Benefit and/or Child
Tax Credit, then as these are affected legacy benefits, they will need to apply for UC instead
and will receive a UC payment as a top-up to their contributory ESA."
This is a bit confusing.
I can't see anywhere in the UC application where you can state you want to stay on Contributions Based ESA.
As I suspected you wade right into answering very deep questions about your health.

Hi Denby
You are correct. I am upset.
I have two kids and my rent is due tomorrow. I am scared to do the wrong thing and get into a hole with the DWP that I can't climb out of. Its terrifying.
It seems there is no forum for UC questions, yet UC is undeniably affected by the other elements which are claimed for.
My partner is gone over 2 weeks now. It seems there is nobody to ask for help, as usual its me on my own, with hundreds of pages to read and no one to help.
I've been in the Support Group 17 years now and I'm extremely sick.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi charlie
New Style ESA is a Contribution Based benefit and is not means tested with the exception of pension income which can reduce the amount that you receive.
The Income Related benefit that goes with NS ESA is Universal Credit.
If you need help with paying your rent then you have to apply for UC, if successful then you can claim the housing element and other elements such as child elements.
If you apply for UC and in receipt of any Tax Credits these will stop.
This forum does not deal with Universal Credit as it can be very complex and we would advise you to seek help from your local Welfare Rights Organisation, you can check what award you may get by completing an online benefit checker gov.uk/benefits-calculators

Hi Charlie
As you are now a single parent with 2 children, have you contacted Gingerbread; 0808 802 0925 for help.
Gingerbread is a charitable organisation for single parents, they have a helpline and they maybe able to help you, they also have a web chat; www.gingerbread.org.uk

Dear Charlie, I have virtually no knowledge of UC and can only echo Gary's suggestion to try Gingerbread for help.
But there is one thing, if you cannot afford your rent please do not leave your landlord whether private, housing association or whatever, in the dark. Let them know ASAP what has happened and that you will need time to sort the benefit situation out. Landlords who simply notice a payment has not come in easily get annoyed, if they know what is happening they are much more likely to be reasonable and sympathetic.
Also beware IVA floggers, there is a lot of dodgy stuff going on with those. CAP [Christians against Poverty] on
0800 328 0006 capuk.org/i-want-help are trustworthy and non-profit, and you do not have to have any religious belief for them to help if they have people near you.
Hope that is some help,
Denby

Thanks for trying to help Gary.
My concern is with the online UC form I am trying to fill out.
There doesn't seem to be anywhere to tick to say I get Contributions Based ESA and would like to continue with that. That is what concerns me most.
